1: IN GENERAL
This documents describes the Terms of Agreement of the TimerGO.com service, web site, and products (later referred to as Service) maintained by TimerGPS Europe Oy (later referred to as Service Provider) that the person (later referred to as User) who has purchased a licence to use must agree to before he or she can use the Service (later referred to as Terms).
2. RIGHTS GRANTED TO THE USER
The User is permitted to use the Service within the limits described by these Terms in accordance of the rules and laws of the User's country or state. By using the Service the User may have access to services provided by third parties under the control of said third parties the use of which may require their own, separate Terms. The User may need to accept these in order to continue using the mentioned third party services. The User may utilize the content and services provided by the Service for personal and private use only. The User may not copy the data, code, databases, or any other part of the Service for use in any other database or service.
In order to use any part of the Service a purchase of a licence is required. Registration is limited only to natural persons – other types of legal entities are not allowed to use the Service. When registering to use the Service the User is granted a personal and private user account and password. The User takes upon himself or herself to safeguard this data (user account and password) and do everything reasonably possible to prevent them from being used by people other than the User. The User is responsible for the use of user account and password information, as well as any action taken by the use of them, whether by the User or some other third party.
3. RESPONSIBILITIES OF THE USER
The User is responsible for all costs incurred by the use or purchase of the hardware equipment, software applications and communication services needed to access and use the Service, as well as their maintenance, installation, and fees. The User agrees that his or her use of these will not disrupt or harm the Service, the Service Provider, or other users of the Internet. The equipment and / or the applications or services that may cause harm or disruption are immediately shut down and disconnected from the Internet by the User.
The User is aware that the Internet as a service platform may cause deficiencies and disruptions in the Service, and that security is under risk in modern communication devices. The User is responsible for the safety and security of his or her own devices, software, and services.
The User is responsible for all the costs and fees incurred by the use of the Service. Such fees and costs include, but are not limited to, paying for a third party in order to be able to access the Internet or use phone.
The User agrees that he or she will not store, disseminate, send, relay reverse engineer, or decompile any material covered by trademark, copyright, or any other immaterial rights to any third party that is generated by the use of this Service, or in this Service, without the express permission granted by the rights holder or copyright provider. The User is responsible for any and all challenges, and their related costs and fees, legal or otherwise, to the material generated by the User by the use of the Service, or in order to use the Service, or in the Service. The User agrees that the material or services stored, disseminated, sent, or relayed by the User in the Service or through the Service for, including but not limited to, sale, loan, or rent are in accordance of the rules and laws of any country where such activity takes place in, and the User has rights to such materials and the required permissions to provide such services.
The User agrees that he or she has the right ro register information about the horses the User trains or owns to the Service for use in the Service. The User has the right to register to the Service the horses and their detailed information whose 1) information is accurate and correct, and 2) information is approved by their owners to be stored in the Service. In the case that the User provides information that is not accurate and correct, or is against the Terms, the Service Provider has the right to remove the horse and its information from the Service or bar the User from accessing the Service.
The Service includes and consists of material that is protected by copyright, trademark, and other applicable laws. The whole Service as such is protected by copyright in accordance to Finland's copyright law. Without the express, written permission from the rights holder, copyright holder, and the Service Provider the User does not have permission to distribute, publish, copy, reverse engineer, decompile or in any other way make known to the public or profit from the material available in the Service, or through the Service. The User may not sell, distribute, or make the Service available in any manner or fashion to others for profit. The User may not include the Service in parts or in whole in web pages,web sites, web services, his or her own, or some other third party for the purpose of making profit without the express, written permission by the Service Provider.
The User grants the Service Provider permanent rights to own, use, and destroy to all the data and files that the User has made available by using the Service. Use covers actvities like, but not necessarily limited to, utilizing the data and files for commercial and non-commercial purposes without separate agreements and payments to the User. The User also grants the Service Provider right to modify, edit, copy, publish, and distribute the material anonymously when the databases and / or its data used by the Service are published by the Service Provider. The Service Provider may not, however, publish such data that is forbidden by laws governing the use of personal and private information regarding the User. The User may at the time of registration forbid the use and distribution of such personal information for commercial purposes.
4. RIGHTS OF THE SERVICE PROVIDER
The Service Provider has the right but no obligation to examine, modify, delete or deny the material deemed inappropriate, especially if such material is against the rules and laws of any country or state where the Service is available. The Service Provider has the right to deny the User the use of the Service if the Service Provider has reason to suspect that the Service is used against the rules and laws of any country or state where the Service is available, or if it is requested by the authorities of these countries.
The Service Provider has right to modify the User's user account, password, or other data related to the use of the Service, if there is a possibility of any of these disrupting the Service or the Service provider's other services.
The Service Provider has the right to modify and change the Service as they see fit, whenever they deem it necessary. This includes the content of the Service, the availability of the Service, and the requirements of the Service. The Service provider will inform of the changes within a reasonable time on the front page of the Service or to the email address provided by the User. These changes do not include technical changes such as, but not necessarily limited to, updates to equipments and software used to run the Service.
The Service Provider has the right to interrupt the availability of the Service temporarily if it is necessary for the Service to function, including, but not limited to, changes to hardware and software used to run the Service, modifications in the communication network infrastructures (e.g. installing new cables, modifications to the existing infrastructure, or maintenance), rules, guidelines, instructions, and / or laws made by the authorities or organisations that necessitate changes to the Service. The Service Provider aims to minimize interruptions cause by such actions if possible. The Service Provider will inform the Users of such interruptions in advance if possible.
5. RESPONSIBILITIES OF THE SERVICE PROVIDER
The Service Provider guarantees that the Service is in accordance of the laws governing such services and aims for a high quality availability of the Service, but will not in any way guarantee the availability of the Service, or the other services granted to the User through the use of the Service. The Service Provider does not guarantee the availability of other third party sites and their services and contents that can be accessed through the Service. The Service Provider is not responsible for the services and contents of third parties that are available and can be accessed through the Service.
The Service Provider is not responsible for any damage to the User, direct or indirect, that take place as a result of using the Service. The Service Provider is not responsible for the accuracy or reliability of the data generated by the Service, or the use of Service, nor for the services, products, or other things that are available for the User through the use of the Service.
The Service Provider is not responsible for the functionality of the Service, nor for disruptions to the Service caused by, but not limited to, technical malfunctions or maintenance, interruptions or breakdowns in the communication networks, nor is the Service Provider responsible for the loss or change of data caused by such events. The Service Provider for their part aim not to cause any disruptions to the Internet. The Service Provider aims for fixing the bugs and interreuptions in the Service in a reasonable time during normal work period after receiving a report of such occurrence without undue delay.
The Service Provider takes reasonable steps to maintain security of the Service, but is not responsible for damages, direct or indirect, due to security, or lack of it, or computer viruses, for example.
6. COST OF THE SERVICE
The Service is available for a fee, and that fee buys a licence that is valid for one year from the time of purchase. Different variations and their related costs can be seen at the Service Provider's web site www.timergo.com. If the Service will incorporate features that are available for a fee, Users can use them after paying the related fee of the feature in question. This fee is separate from the licence fee.
7. REGISTERING PERSONAL INFORMATION
The Service Provider will save the data provided by the User during the registration process to a customer database needed by the Service, as well as other Service related databases. Such customer data is used by the Service and for the purposes of customer service. In addition the information may be used in customer related marketing, customer service, and other Service related activities, such as polls and market research.
The User has right to know what has been stored in the Service Provider's databases. The registration holder is TimerGPS Europe Oy, at the following address: Tyrnäväntie 12, 90400 Oulu, Finland. All inquiries regarding the personal data must be made in writing, signed by the User, or by visiting the Service Provider in person.
8. COOKIES
The Service utilizes cookies. A cookie is a small text file stored in the User's device accessing the Service, which is used for various purposes, such as recognizing the people visiting the site frequently, help users in logging in, and analysing users of a site. With the help of the cookies the Service Provider is able to enhance the Service further. Cookies, when properly used, do not harm their users, their devices or files. In case they are not desired their use can be prevented by the User by modifying the settings of the User's browsers. Not allowing cookies may have an adverse effect on the functionality of the Service.
9. RIGHTS TO CONTENT AND MATERIAL
All rights of the material produced by the Service Provider belong to the Service Provider, whether that right is copyright, immaterial or any other right.
The content and material generated and stored by the User will become part of the Service Provider's databases and as such can be made public in whole or in part by the Service Provider without a further fee or payment to the User.
The Service provider has the right to make public the data stored in the Service Provider's databases in whole or in part. This data will be anonymized, without any links to a horse or a person. TimerGPS Europe Oy may publish and use this data in advertising and printed products and / or other forms of communication.
10. CHANGING TERMS OF AGREEMENT
Any deviations from these Terms must be made available in writing or through the Service for the User. Changes take effect immediately. The User will accept the changes by continuing to use the Service after being notified of the changes.
11. DISPUTES
These Terms are governed by Finnish law. Any legal dispute with these Terms must be at first solved by negotiation. If no agreement is reached, the User agrees that the dispute will be under the jurisdiction of the general court of the Oulu District Court in Finland.
